• Understanding rights under employment agreements. Executive agreements contain complex terms related to change in control, good reason and cause, long term incentives, noncompetition restrictions, and arbitration. Samantha is familiar with these terms and the facts needed to make your best case.
• Asking for compensation upon separation. Executives’ agreements often grant them special rights to severance pay when they leave a company. Even leaders whose contracts have no right of severance may have the opportunity to negotiate severance. This is particularly true for high-level personnel that believe they may be forced out due to illegal discrimination or retaliation. Samantha has assisted many executives and leaders formulate paid exit strategies.
• Developing litigation strategy. Most company leaders are subject to arbitration provisions which affect litigation strategy. Samantha has arbitrated over 100 labor and employment cases before various arbitration administrators, and is familiar with the special requirements of arbitration.
