Severance from Work
You may have been discharged or laid off from work and offered a severance agreement to review. Samantha has 25+ years of employment law expertise, and she has reviewed hundreds of termination scenarios. Samantha can help with the following:
• Reviewing the circumstances of your termination. Samantha will assess the factors that led to your job loss, and provide her opinion as to whether she believes that there may be some illegal motivation underlying your discharge.
• Assessing the amount offered in severance. Once there is an understanding of the motivation for your selection for layoff or termination, Samantha can assess the amount of severance your employer is offering to determine if this is fair and reasonable compensation for your job loss.
• Discussion of other applicable employment agreements. Many employees sign confidentiality/NDA or noncompete agreements when they are hired. These agreements usually are enforceable and will affect your job search. Samantha can review these agreements and explain how their terms may keep you from working in the same field.
• Understanding your rights under the severance agreement. Severance agreements often are complex. They may contain terms which impact your next job (such as agreements not to compete or seek business from company clients).
Even boilerplate language has real-world implications.
• Help decide whether to accept the severance or negotiate for more. Samantha will provide recommendations as to whether to accept the severance offered, negotiate for more, or reject it outright.
Please note that these agreements have very strict timelines for review (often 21 days), so it is crucial that you contact an employment lawyer immediately for review. Most lawyers cannot review agreements with seven days or less of time left.
